living in this country illegally. now is the time for immigration reform some say. they say the election is proof that this country is ready for action. maryland voters passed the dream act granting instate tuition to the children of undocumented immigrants who graduate high school and pay taxes. opponents are vowing to fight any proposal. >> to make all these people instantly citizens is going to put a tremendous strain on the -- our soal services system across the country. we cannot afford it. for people that don't deserve it. >> it's a daily threat that families could be torn apart at any instant. it's something that i have personally lived with and it's something that i wouldn't wish on anyone. >> activists plan to show their support for immediate action at a rally on capitol hill in april. had morning, prince george's county police are on the hunt for a suspect in a deadly shooting? landover. officers received the call yesterday afternoon for a shooting in the 8500 block of o

beltway. a man was found suffering from multiple gunshot wounds. he was pronounced dead on the scene. police are not releasing any information about the victim a possible suspect. closing arguments begin in the misconduct trial involving an anne arundel county executive. john leopold is accused of misusing funds and using his security detail for personal errands, including driving him around so he could with have an affair and working overtime to put campaign signs around the area. accusations that he abused his power are too vague, his lawyers say. he could eventually be removed when -- a jury will continue dlib rakes in the murder trial involving a former culpeper police officer. daniel harmon-wright is accused of murdering 54-year-old patricia cook last february. he was responding to a call of cook trespassing on the church's property. after an argument, he trapped his arm inside her window and

she tried to drive off. he says he shot her in self-defense but prosecutors say it was a cold blooded killing. if convicted, he faces from a year to life in prison. a bethesda preschool teacher faces up to 40 years in prison on child pornography charges. james douglas manning taped himself abusing children in the 1990s. he agreed to a plea deal. manning was arrested in november after finding his dvds as part of a national pornography sting. the longest certificate flg delegate in maryland's house has died. hattie harrison passed away last night. she was born in south carolina but attended school in baltimore and was a teacher for much of her life. she was first elect toed to the house of delegates in 1993 and -- she was the first african-american woman to hold such a position in the general assembly. hattie harrison was 84 years old. we're hoping to learn today

the search is on for a u.s. fighter jet missing off the coast of italy. the f-16 took off from aviano air base in italy for a training mission last night. the pilot sent out a distress signal over the aidry attic sea. only the pilot was on board. it's not believed that the aircraft was carrying weapons. also happening right now, at least two people are dead after a suicide bomb attack outside the somalian prime minister's office. the attacker detonated bomb as he was being questioned at a checkpoint. dozens nearby were wounded. the prime minister and president were not hurt. the california man is in jail had morning accused of

shooting and killing a doctor at his office. police say the man opened fire in an examination room yesterday afternoon in newport beach. an employee says the suspect had an appointment with the doctor. officers arrested the gunman immediately and are investigating just what caused that deadly shooting. one person is dead after a trench collapsed at a construction site near dallas. the crew was digging it yesterday afternoon for a new water line when it collapsed and one of the workers fell in. no one else was hurt in the accident. a scary scene in new york as a runaway bus rolls down madison avenue during evening rush hour. riders say last night their driver passed out, slumped over the wheel and the bus started picking up speed, slamming into cars. one of the passengers jumped into action grabbing the wheel and eventually stopping the runaway bus. >> i hear the woman in front of me scream and i see the driver is out. the bus is going faster. >> i grabbed the wheel. as soon as is i saw we hitting

cars, i jumped on the wheel and grabbed the wheem. >> paramedics treated 12 people for skinjuries. we're getting to hear the frantic calls minutes after a small plane crashed into the icy hudson river near new york city. the small piper aircraft went down sunday near yonkers, new york, north of manhattan. it was carrying a pilot and passenger on a sightseeing trip. in the call, you can hear the caller describe the scene. he tells the dispatcher he's afraid he won't make it out as the plane filled with water and started to sink. >> how many people on board? >> two aboard. >> do you have life preservers sh. >> we do, yes. >> are you in the water now? >> we're in the water, filling up. >> we're going down. >> okay, sir? >> yes? >> i need you to get out of the plane and let me know when you're out. >> i am out of the plane. >> okay. where is your -- >> i'm out of the plane. i'm going to lose you.

i'm going to lose you. >> both people made it out and stayed afloat with life vests until help arrived. they were taken to a local hospital and treated for hypothermia. both are expected to be okay. the ntsb is investigating. thousands of defense department workers are about to be out of a job. the pentagon is laying off 46,000 temporary and contract workers because of budget cuts. the rest of the workforce would face furloughs of one day per week without pay. those furloughs would last the rest of the 2013 fiscal year. it's all in an attempt to manage the $45 billion in automatic budget cuts set to kick in march 1st. emergency relief aid is finally on the way to those affect ld by superstorm sandy. the senate cleared the bill 62-36 late monday evening. the house passed the bill two weeks ago. president obama sent praises to congress for passing the $50 billion emergency relief measure. the measure is aimed primarily at helping residents and businesses as well as state and local governments rebuild.

sandy hit the east coast in october and is blamed for more than 130 deaths and billions of dollars in property damage. 5:19 now. al gore is taking on the future. the former vice president has a new book out called the future. six drivers of global change. in it, he focuses on the way economics, global warming, the digital revolution and the shift in global power will impact the future. he'll talk more about the book in an exclusive interview with matt lauer later this morning on "today" after "news4 today" starting at 7:00. check out this rare explosion. amazing pictures here. a volcano in russia continues to erupt shoot gas and ash into the sky. they were dormant for almost 40 years. it started erupting just in november. officials say there is no need for residents to worry yet. the nearest town is 40 miles away. the scientists are keeping a close eye on it as you would expect. >> that's right. might want to get out of dodge sooner than that. it's 5:21ment time for weather and traffic on the 1s.

meteorologist tom kierein here with big changes in your forecast. tom, good morning. >> good morning much there's a live view from the nbc4 city camera showing a mostly partly cloudy sky around the region. not a lot of o fog in the metro area. there is patchy dense fog in the rural areas in the wake of the overnight sprinkles. right now a few sprinkles radar. these patches of green, central shenandoah valley, front royal west to north centr west virginia. in the metro area, it's above freezing. we stayed above freezing overnig overnight. upper 30s to mid-30s in southern montgomery county. southern prince george's, the mid-40s. arlington county is near 40 degrees, much of fairfax county, the upper 30s to mid-40s. reston at 45. much of loudoun county, the upper 30s. montgomery county the northern part, the mid-30s. farther south and west from fauquier county toward prince william county and into stafford and spotsylvania, the upper 30s

could soon cost you in virginia. virginia senate committee has endorsed a bill making it illegal. the bill covers kids under the age of 15 and breaking the law draws a $100 fine. a similar bill died in the general assembly two years ago. there are a lot of intriguing storylines in this year's super bowl. one includes 49ers tight end vernon davis who raised here in d.c. davis was raised by his grandmother who still lives in northwest. his family had a difficult year. his younger brother michael is awaiting trial for allegedly killing someone with a hammer last year. despite these challenges, davis' grandmother says vernon is ready for the biggest game of his life on sunday. >> he's telling me thaim ready mom. i'm ready. i said i know you are. i said you nervous because you can't be nervous. go in and treat it like it's just another game that you only playing a little harder. >> grandma knows best. vernon might not be nervous, his grandmother definitely is. she says she gets anxious, she

they've got a plan ready to go. legislation that they can vote on now cording to the white house, what the president will outline during his speech in las vegas today is similar to what we heard from the four democrats and republicans. they're sort of framework for immigration yesterday. illegal immigrants getting to the back of the line but having to go through background checks, fines, taxes, learning english to get the opportunity to stay legally in this country. but conservatives say they want to see the border beefed up first. this time people here on capitol hill think it could happen because both sides are motivated. >> we're going to get pushback but most americans are saying enough already. let's get this fixed. >> we have to come to an agreement. we have to heat in the middle. that the mission of getting a bill done to strengthen america is more important than any of us clinging it a specific belief. >> that motivation includes democrats trying to keep the president's first term promise

and republicans trying to get a chunk of the latino vote in this country. >> tracie, thank you for that update. john kerry could be secretary of state by next weekend. the senate will likely vote today on whether to make him the next secretary of state. not expecting kerry to have trouble winning support from his peers in the senate. he'll then resign from the senate in order to take his new post. his resignation would be effective on friday. we should know who will replace kerry in the senate. massachusetts governor deval patrick will -- the boy scouts announced it could ease the nationwide ban on gays. a local unit decided to lift the controversial ban. last week, cub pack 442 in maryland county posted a statement on its website. it said the pack would not discriminate against any individual or family based on race, religion, able or sexual

orientati orientation. they threatened to strip the pack of the charter but the pack wouldn't take it down. >> just to show the kids our sons, daughters on some, you know, just stand up for something that you believe in. >> if the boy scouts of america does lift the ban, would still allow local organizations to enforce their own bans. police are looking for the man in this video. he's a person of interest in connection with a sexual assault in northwest washington. the video shows a man walking near the crime scene in the 1400 block of florida avenue. the attack happened sunday, january 20th. if you recognize the man in the video, contact police. the man accused of killing a woman at a bus stop in northwest washington says he met the woman on the social media website tagged. 18-year-old siohban lee was found dead early friday morning. police arrested and charged burglary for the murder. he says he's innocent.

buckley told police he got her phone after someone else shot her at fifth and nick will son streets. tagged is a site that allows people to meet, chat and flirt over the internet. what do with extra money. gray will announce today that the district has a budget surplus and this is no small chunk of change. we're talking about $400 million. that money is coming from extra tax revenue generated by the booming commercial real estate market. virginia lawmakers passed an amendment ending the commonwealth's unique law prohibiting governors to run for two term. it passed in the state senate 25-15. supporters say it gives them more power and say -- who leads the state. others think virginia has been so successful because the one-term limit makes lawmakers act faster. the measure still has to pass through the general assemblies before it can become law. it may soon be legal to

welcome back. happening now, at least two people are dead after a suicide bomb attack out the somalian prime minister's house. he was being questioned at a checkpoint. dozens nearby were wounded. the prime minister and president were not hurt. we're learning more about the safety violations inside a brazilian nightclub where 231 people died in a fire. the nightclub kiss had no fire alarm, no sprinklers, very few fire extinguishers and only one exit for 1300 people.

pyrotechnics during a performance set soundproofing material on fire. security guards initially blocked the door. at least three have been arrested including the club owner and two band members. the tragedy has once again brought up concerns about nightclub safety here. several fire departments in our area say they do regular safety checks making sure there are lit exit signs and pull-down fire alarms and smoke detectors and sprinklers and more than one exit. most jurisdictions do not allow pyrotechnic. to an exclusive. a swat team officer is opening up about a raid that could have cost him his life. he and his team raided an apartment in forestville yesterday looking for a drug suspect. they had to use a battering ram to break down the apartment's steel door. according to police, as the officers tried over and over again to get into the unit, the suspect inside the apartment opened fire. his bullet got lodged in that steel door. >> you got use the best tactics

and put your training into place and hope that that day is not your number. >> police found drugs, weapons and hundreds of rounds of ammunition in the apartment. the suspect, jeremiah, pearson is charged with attempted murder. a senate committee holds its first hearings over president obama's proposed gun control legislation. the president getting support from police chiefs who have dealt with mass shootings firsthand. chiefs from newtown, connecticut, aurora, colorado and tucson, arizona were at the white house yesterday urging congress to act on tightening the nation's gun laws. montgomery county police chief thomas manger was also there for the meeting. with gun control front and center and congress, more and more people are talking about the debate as well. >> my second semester class at virginia tech, i found myself sitting in class and that's when my life changed. >> last night in green belt, people gathered to watch the documentary, living for 32. about the survivors of the virginia tech massacre. there was also a discussion

about the current gun control debate. gun owners say the proposed assault weapons ban punishes them for the actions of criminals but gun control advocates argue there are some firearms that simply civilians don't need. >> i don't support the assault weapons ban because it's aimed at lawful gun owners. >> i'm not taking your gun for you to hunt. i am taking your assault weapon that you don't hunt with and i'm taking your ammunition clip that you don't need 20 shots, 30 shots. >> also in attendance last night, elizabeth ross, her son marquel was shot and killed while walking to school in prince george's county. d.c. catering companies are under the microscope after a weekend shooting that injured five people. it happened at d.c. sound stage which does not have a liquor license. but was using a caterer that did. police now believe some establishments may be using caterers on a regular basis to

skirt liquor laws in operated bars under the city's radar. d.c. sound stage has been shut down by police chief lanier and she could do the same to the caterer, roadside cafe, that would be a first in the city. kids home-schooled in virginia may skoon get a chance to play sports at public high schools. it's dubbed the tebow bill named after the nfl star home-schooled in florida but allowed to play football at his local high school. virginia lawmakers first introduced the bill in 2005, it failed every year since. they say it gives home-schooled kids an unfair advantage because they don't have the same academic criteria as public school athletes. players for the ravens and 49ers will get a chance to see the lighter side of the super bowl. today is media day down in new orleans. every tv station and website is sending at least one reporter to today's event. i love this. you can count on unique costumes and questions. in years past, players have salsa danced with reporters, worn goofy hats during the

in virginia. we'll talk about details in ten minutes. angie and eun, over to you. >> thanks, danella, 5:53 now. chevron is making corrective actions in response to a large fire at a refinery last summer. the oil company says it's paid about $10 million to settle nearly 24,000 claims from the fire near san francisco. most of that money went to hospitals for medical exams and treatments right after the incident. many people complained of eye and breathing problems after the fire sent a cloud of gas and black smoke over their homes. chevron is also taking steps to make sure fires like that one don't happen again. it's the time you've been waiting for. open up that filing cabinet. it's time to submit those taxes. the irs will officially begin processing returns tomorrow. tax season was to begin on the 22nd. but the agency had to push back the date because of changes to tax policy made in the last minute fiscal cliff deal. many online or tax filing services have been accepting

returns but they will not submit them until tomorrow. the irs says e-file is the fastest way to get a refund. futures are flat. cnbc's shartia brantley has that story and more. good morning. >> good morning, eun. futures are flat after the markets took a breather on monday. the dow snapping the seven-day winning streak while the s&p 500 ended after eight days. tech may get a boost after yahoo! reported decent earnings last night. home prices and consumer confidence and more earnings from ford. eli, lily and pfizer. the fed kicks off a meeting that's expected to signal it will keep rates low for a long time. the dow falling 14 points to 13,881. but the nasdaq added 4 to 3154. meanwhile, a new report from a consumer watchdog group says states are forcing jobless americans to pay millions in
